The Panel is aware that the Governing Council is considering the issue of duplication of awards resulting from, inter alia, related or competing claims for the ownership of a business.

Instead, the US urged that competing claims be resolved through negotiation.

All of the competing claimants were interviewed during the technical missions to Kuwait and Jordan.

Upon review of all documents submitted by the competing claimants, the Panel was unable to find any evidence that supported this contention.

After extensive claim development and the verification measures described earlier in this report, the Panel was able to resolve the competing claims in the instalment.

In category D , competing claims are identified after conducting extensive database cross checks on claimant names, partner names, business names, civil identification numbers, business licence numbers, chamber of commerce identification numbers and other identifying data.

This instalment contains a number of competing claims for the losses of the same unincorporated business in Kuwait, some of which involve previously awarded claims.

In the third group of competing claims, two Palestinian claimants, a Kuwaiti claimant and a Jordanian claimant filed category D claims for the losses of a group of lighting businesses in Kuwait.

In the second set of competing claims, a Palestinian claimant and a Kuwaiti claimant filed separate claims in category D for the losses of a printing business in Kuwait.

The following are some the competing theories.

Duplicate claims

Category C corrections Recommendations for corrections to category C claims are those arising from confirmed duplicate claims, discrepancies between the electronic and paper claim formats, and multiple recovery based on the duplication of claim awards.

Stand alone claims

A similar exercise was conducted with respect to category C for the purpose of identifying duplicate claims during claims processing.

Concerning the issue of duplicate claims, the secretariat indicated that it was aware of the risk of duplicate claims from the outset of claims processing and took steps to identify and eliminate such claims during the course of claims processing.

In connection with the claims by governments for loss of life and reduced quality of life of their nationals, Iraq asserts that the claims are inadmissible because the Claimants concerned lack legal standing to bring such claims before the Commission.

The Panel notes that common traits displayed by these claim preparers include their command of the English language and familiarity with the Commission's claim development procedures and jurisprudence from the regular claims programme.

The secretariat has also used these electronic searches for duplicate claims in the Palestinian late claims programme, the Bedouin programme and the category A and C late claims programme.
