Insecure title affects decisions to invest and inhibits the use of land as collateral or the issuing of loans or mortgages.

In other States, term loans secured by movables other assets, such as equipment and even intellectual property, are common.

Coercive restructuring of insolvent banks unsecured debt would be next.

These borrowings caused a surge in non performing bank loans in the early and mid 1990 s, when total non performing loans hit 40 of GDP.

Moreover, defaults on securitized credit card debt and commercial loans to companies that are driven to bankruptcy are still to come.

To be sure, they will help to prevent banks from using instruments resembling collateralized debt obligations (which banks use to repackage individual loans for placement on secondary markets) to reduce their exposure.

This means no cross border sovereign debt (or esoteric instruments, such as collateralized debt obligations).
