Chart 2 Spousal Violence Cases, 2003

The Committee welcomes the enactment in 2002 of the Marital Rape Ordinance.

Marital rape occurs across cultures, and may not be considered a crime.

Accidents are rare but most common with collisions, hockey games, or pair skating.

The following chart illustrates offences upon which spousal cases were recorded.

Comparisons between the 1999 General Social Survey and the 1993 Survey on Violence Against Women point to a decline in the rate of spousal violence against women over time.

In addition, with the amendments to the Criminal Code in 2004, paragraph 5 relating to private lawsuit in cases of marital or extramarital rape was abolished.

The lack of legal prohibition of, or redress for, marital rape in many societies serves to perpetuate the idea that women have no choice but to submit to their husband's sexual desires, entirely on the man's terms.

And they are heterosexuals who come from countries that have traditions of polygamy and relatively high levels of female autonomy, and almost all of those countries are in east or southern Africa.

The law would permit marital rape, limit women s movements say, for work or study without male permission, and even make it illegal for a woman to refuse to dress as her husband wishes.

There was also the problem of a dowry being paid upon marriage, which the report stated was banned under Gabonese law, but which persisted as a custom in the country. Did the fact that it was paid, although it did not exist under civil law, make it an integral part of the marriage bonds? And if that was correct, could a husband refuse to let his wife divorce him unless she repaid the dowry?
