The subgroup on children and violence established within the NGO Group for the Convention on the Rights of the Child and the NGO Advisory Panel for the study have been active in the reporting period, in particular in the context of children in conflict with the law.

50. As concerns the treatment of juvenile delinquents, there are three age groups children below nine years of age are not prosecuted, those aged from 9 to 15 can be prosecuted, while persons over 15 years of age are considered as adults.

The NGO Advisory Panel will convene an expert consultation on this issue on 4 and 5 April 2005, with a view to identifying key issues and research and developing appropriate recommendations for the United Nations and Governments aimed at eliminating violence against children in conflict with the law.

The Committee is seriously concerned that no safe houses or places of alternative care exist for boys who suffer from parental neglect or who need to be removed from their family environment, and that they are generally placed in the facility for boys in conflict with the law.

(d) Since mandatory sentences restrict the discretion of the courts in considering the circumstances of each offender and in applying alternative sanctions, States that have not yet done so should consider enacting legislation that provides for flexibility in sentencing, as well as for the imposition of non custodial measures.

Ms. Azouri (Lebanon) said that prostitution continued to be illegal but legislation had been introduced since the initial report to protect minors and treat minor offenders, not under the Penal Code but as a separate category with emphasis on care and protection.

These groups, often the poorest of the poor, are under represented on the staff of the justice system, the police and all law enforcement services, over represented among victims, and inordinately prevalent among lawbreakers, in the prison system and on death row.

The Committee notes that long periods of imprisonment for delinquent children set forth in national penal legislation are not in conformity with the provisions of article 37 of the Convention and that every child alleged to have or accused of having infringed the penal law should have the guarantees envisaged in article 40 of the Convention.
