The following is the draft provisional agenda for the thirty eighth session of the Committee

The Committee adopted a report on its thirty eighth session (CRC C 146).

At its 40th meeting, on 27 July, the Council had before it the draft resolution contained in the report of the Secretary General (E 2005 53), entitled Work of the Committee of Experts on the Transport of Dangerous Goods and on the Globally Harmonized System of Classification and Labelling of Chemicals and proposed amendments to the draft resolution submitted by the Vice President of the Council, Agim Nesho (Albania), on the basis of informal consultations (E 2005 L.42).

The Bureau recommended that the Commission establish explicitly an order of rotation at its thirty eighth session.

The thirty eighth session was authorized to be held for three weeks from 4 to 22 July 2005.

The Bureau recommended that the Commission establish explicitly at its thirty eighth session the order of rotation of the Chairmanship of the Bureau of the Commission so that it might start being implemented upon the election of the Bureau for the thirty ninth session.

16. Notes that the Scientific and Technical Subcommittee at its thirty eighth session will submit its proposal to the Committee for a draft provisional agenda for the thirty ninth session of the Subcommittee, in 2002

The Commission held its thirty eighth session at United Nations Headquarters from 4 to 8 April 2005.

Nevertheless, according to the informal system of rotation used so far, the Chair for the thirty eighth session should be elected from the African group.

In accordance with its decision 2004 2, the Commission, immediately following the closure of its thirty eighth session, held the first meeting of its thirty ninth session for the sole purpose of electing the new Chairman and other officers of the Commission.

On the recommendation of the Commission at its thirty eighth session, the Economic and Social Council, in its decision 2005 245 of 22 July 2005, approved the provisional agenda and documentation for the thirty ninth session of the Commission.

One solution would be for the current Bureau to remain in charge until the election of the next Bureau at the end of the thirty eighth session.

It was noted, however, that some members of the current Bureau belonged to States that would no longer be members of the Commission during the thirty eighth session.

The Bureau encouraged UNFPA to schedule a time slot for the event with a view to ensuring that delegates participating in the thirty eighth session would be able to attend.

At the Commission's thirty eighth session, the Secretariat will present to the Commission a preliminary analysis of the replies, as requested by the Commission (A CN.9 585).
