Mr. La Yifan (China) asked how OHCHR would deploy its new resources to ensure that economic, social and cultural rights were enjoyed as effectively as civil and political rights.

Human rights law does not prohibit all distinctions in treatment in the enjoyment of rights.

This is particularly visible in the Gaza Strip, which is denied any possibility for enjoyment of rights, fundamental freedoms and liberty.

Article 26 of the International Covenant on Civil and Political Rights (ICCPR) stipulates equality all persons are equal before the law and entitled without any discrimination to the equal protection of the law .

Drawing the attention of the State party to its general recommendation XXX on discrimination against non citizens, the Committee recommends that the State party ensure the effective enjoyment, without discrimination, of the rights mentioned in article 5 of the Convention, in particular their access to justice and right to health.

The Committee urges the State party to pay particular attention to the situation of the girl child, in particular girls living in rural areas, in order to halt the practices of forced marriage and bridal kidnapping, which prevent the girl child from fully enjoying the rights enshrined in the Convention.

The Special Rapporteur on the right to health notes that Mozambique, while it has assumed many international obligations in the area of health, has not ratified the International Covenant on Economic, Social and Cultural Rights, and urges it to do so as soon as possible.
