The Commission, in my view, eloquently and powerfully argues that referral to the ICC is the best means by which to halt ongoing violations and to prevent future ones.

While some agreed that it had been able to report a number of criminal offences, others felt that the picture was incomplete.

The US strongly resisted the jurisdiction of the ICC, but American abuses at Abu Ghraib show why the US, should be subject to international law.

France, too, believed that referral to the International Criminal Court was the only solution both because we believe that it is our duty to do right by the victims and because taking such action will prevent the violations from continuing.

35. The Commission condemns the continuing violations of the rights of women and girls and the climate of impunity in which such violations occur, and stresses the need to investigate, prosecute and punish those responsible for such violations.

The parties and Governments concerned must ensure, inter alia by arresting persons for whom an arrest warrant has been issued by the International Criminal Court, that those responsible for such violations are brought to justice and that human rights and international humanitarian law are respected.

The International Criminal Court is complementary to national criminal jurisdictions.
