(b) Executive Committee of the Multilateral Fund The terms of reference of the Executive Committee approved by the Fourth Meeting of the Parties stipulates that the Executive Committee shall consist of 14 members, seven from the group of Parties operating under Article 5, paragraph 1, of the Protocol, and seven from the group of Parties not so operating.

A5 consumption in 2002 was 19 below the A5 Baseline (3) see Figure 1 below.

The Chair thanked the task force members for their presentation and suggested the creation of a contact group consisting of nine members from Parties operating under paragraph 1 of Article 5 and nine members from Parties not operating under paragraph 1 of Article 5.

Another representative pointed out that limits on emissions from process agent uses currently applied only to Parties not operating under paragraph 1 of Article 5, so there was no reason for emissions data from Parties operating under paragraph 1 of Article 5 to be included in the table.

Update oOn Mmethyl bBromide rReductions Iin Article 5 Parties

Parties operating under paragraph 1 of Article 5 ( A5 Parties ) have continued to make substantial progress in achieving MB reductions since the previous EC reports(1).

Most A5 Parties have achieved the MB reductions scheduled in MLF projects.

The following non Article 5 Parties had reported production of controlled ozone depleting substances for 2004 Canada, Czech Republic, Greece and Israel.

The office of Chair has effect from 1 January of the year in which the term of office commences and is subject to rotation, on an annual basis, between the Parties operating under paragraph 1 of article 5 and the Parties not so operating.

Related emissions in Parties not operating under paragraph 1 of Article 5 were estimated at 186.1 metric tonnes in 2002, and in relation to calculated emissions in Parties operating under paragraph 1 of Article 5, there was a discrepancy which CTOC would try to resolve.

In that same decision, they had also agreed that the issue of seats for Parties operating under paragraph 1 of Article 5 and those not so operating should be added to the agenda of the twenty fifth meeting of the Open ended Working Group for further consideration.

Also communicate with the Governments and primary distributors in the two or three countries (representing Parties operating under Article 5 and Parties not operating under Article 5) responsible for the majority of the transit and transshipment of ozone depleting substances to discuss the same matters.

It was further requested that the secretariat provide Parties with an estimate of the cost of funding the participation of Parties not operating under paragraph 1 of Article 5 as identified by TEAP in its report on administrative issues.

Assuming the list of members included in the last report of the Panel is current, there are currently 113 members from non Article 5 Parties.

She added, however, that success in tackling illegal trade depended on the political will to enforce domestic regulations, and therefore Parties not operating under paragraph 1 of Article 5 could not be expected to solve the problem on their own.

In view of the fact that the number of tasks assigned to TEAP had been increasing, he suggested that the Parties consider innovative ways of supporting members from Parties not operating under paragraph 1 of Article 5.

Subsequent to 19 October 2005, the Secretariat received the following information and clarifications from non Article 5 Parties related to deviations from consumption reduction schedules for the year 2004

After consideration of theis above list, one Party expert noted that the present level of funding provided to Parties operating under Article 5 through rRefrigerant mManagement pPlans (RMPs) and other Multilateral Fund activities mightay not be sufficient to enable them to fully address fully the illegal trade issue.
