B. Bilateral tripartite agreements on competition law

Recognizing further the need for effective competition law enforcement,

The draft COMESA Competition Regulations apply to all economic activity whether conducted by private or public entities and have primary jurisdiction over industries or sectors, which are the subject of a separate regulatory entity.

Anti cartel enforcement cannot be done in isolation, however it is interdependent with competition law enforcement.

Finally, developing countries can begin to establish bilateral cooperative arrangements with their neighbors and trading partners in competition law enforcement.

It begins with brief descriptions of several recent cartel cases in countries that have been actively enforcing competition laws for a relatively short period of time.

Nevertheless, it has also been suggested that a broader limitation to bilateral cooperation tends to take place among countries which are economically interdependent and share a similar level of experience in competition law enforcement or the same ideas on competition policy.

Effective enforcement of competition law can prevent the likely adverse effects by prohibiting such mergers, allowing them with conditions or issuing divest orders, as may be provided by the relevant competition law provisions.
