Am I missing something here?

The Prosecutor and courts overlooked factual discrepancies, incriminating objective evidence and unlikely statements of police officers.

Early in my career, this reaction troubled me it made me wonder whether I had, in fact, overlooked something obvious.

He noted that other truth and reconciliation commissions had neglected the importance of the threat of prosecution as an incentive to testify and had instead only focused on a commission's ability to grant amnesty.

In the same vein, it also disregarded its obligation, under article 13, to ensure the complainant's right to complain and to have his case promptly and impartially examined by the competent authorities.

He refers to the findings of the judge and claims that her evaluation of the evidence in the case was partial, and that she overlooked serious inconsistencies in the police officers' testimonies, as well as her choice and interpretation of national jurisprudence, was arbitrary and not impartial.

The paragraph also omitted to mention that the displacement of the civilian population was not a war crime when required for the security of the civilians involved or for imperative military reasons.

The Committee also notes that some States may have omitted to submit information on their national committees, as the guidance issued by the Committee to assist States in preparing their reports did not specifically ask States for this information.

I shall be brief, as time does not permit me to speak for as long as the situation deserves. But I should like to cite some of the omissions, as well as some of the issues included, in the document that should merit a very broad ranging, careful and in depth debate in the Assembly.

4.8 In response to the authors' reference to article 8 of the European Convention, the State party observes that a list of permissible exceptions to the right such as contained there was deliberately omitted from the draft of article 17 of the Covenant, in order to give States a wide discretion to determine permissible forms of interference.
