A woman who, after using her maternity leave, works full time has the right to be absent from work two times per day in the duration of one hour for the purpose of breastfeeding her child, on the basis of a finding issued by an authorized doctor.

They are entitled to a maternity allowance that is payable in three segments (article 29).

Article 33 of that law covers legal issues that encourage reproductive processes, the right of women to decide the question of maternity for themselves, and the provision of the appropriate medical services during pregnancy, childbirth, and the post natal period.

These services, based on the concept of informed choice, should include education on safe motherhood, prenatal care that is focused and effective, maternal nutrition programmes, adequate delivery assistance that avoids excessive recourse to caesarean sections and provides for obstetric emergencies referral services for pregnancy, childbirth and abortion complications post natal care and family planning.

11.19 In the only study carried out to find general level of awareness of s36 of the Employment Act by female employees in Port Vila, it was found that they were aware of the general maternity provisions but they were not fully aware of their nursing leave entitlements as shown in Figure 12.
