Illegal trade in ozone depleting substances is controlled by the 1987 Montreal Protocol on Substances that Deplete the Ozone Layer, which aims to gradually reduce and finally phase out all ozone depleting substances.

To date, Botswana has not reported its 2004 ODS consumption data but has advised that efforts are being made to prepare its ODS licensing and quota system.

(h) Tracking illegal trade in ODS may might be done through the inspection of producing plants and distributors by collecting data on purchased ODS and addresses of traders.

Kyrgyzstan has reported the establishment of a system for licensing the import and export of ODS.

A government formed of a coalition of the ODS, KDU ČSL, and the Green Party (SZ), and led by the leader of the ODS Mirek Topolánek finally succeeded in winning a vote of confidence on 19 January 2007.

The Party's representative to the last meeting of the Committee advised that draft laws on consumption of ODS and on regulation of ODS imports had been approved by Guinea Bissau's Council of Ministers and by the President of the Republic.

(b) Customs training and provision of tools for analysis of ozone depleting substances should be intensified, and cooperation between importing and exporting Parties increased to address the problem of mislabelling of ODS

Some representatives raised concerns about the impact of any new tracking system for ozone depleting substances, particularly in terms of the additional burdens it might impose on countries exporting ozone depleting substances.

UNDP further advised that, following Armenia's reclassification at the Fourteenth Meeting of the Parties as a Party operating under Article 5, the GEF Council had debated whether or not it should continue providing assistance to the Party, and had decided to maintain the assistance.

Turkey has notified the Secretariat that it has established a system for licensing imports and exports of ODS.

The plan includes the Party's commitment to reduce its methyl bromide consumption from 30 ODP tonnes in 2002 to 24 ODP tonnes in 2004, and to introduce a ban on imports of ODS using equipment in the first quarter of 2004.

The report concluded that progress had been made in the reduction of process agent related emissions through Executive Committee projects aimed at converting existing processes using ozone depleting substances to processes that do not use ozone depleting substances.

Lesotho ishas yet to notify the Ozone Secretariat that it has established a system for licensing the import and export of ODS.

Economic incentives would be needed to encourage users to replace the equipment and to recover and transport the ozone depleting substances.

Trafficking in ozone depleting substances

The Montreal Protocol on Substances that Deplete the Ozone Layer of the Vienna Convention for the Protection of the Ozone Layer provides the framework for Parties to phase out the production and consumption of ozone depleting substances (ODS) according to a strict time table.

Likewise, export licensing systems or bans for re exporting ozone depleting substances were rare, as were import prohibitions for equipment containing ozone depleting substances.

Since 1996, the Parties have allowed a global exemption for the small amount of ozone depleting substances used for laboratory and analytical uses.

In some countries illegal trade in ozone depleting substances has increased dramatically and a variety of smuggling methods have emerged.

(a) There is a need to develop a tracking system of ODS to monitor goods in transit

Information reported by the Parties to the Montreal Protocol on illegal trade in ozone depleting substances (decision XIV 7) By paragraph 7 of decision XIV 7, the Parties to the Montreal Protocol requested the Secretariat to collect any information on illegal trade received from the Parties and to disseminate it to them.

(g) There should be a requirement for cross checking licenses for ODS between exporting and importing authorities through the exchange of copies of actual amounts of ODS exported and imported, a procedure which mightay reduce illegal trade

The progress report further stated that the Party introduced a system for the apportion ment of ODS import and export in April 2005.

The draft terms of reference for a feasibility study on developing a system for tracking the movement of ozone depleting substances are contained in Annex IIthe annex to II to the report.

These include the initiation of web based access to the ozone depleting substance data reports, with a query function that will enable Parties to obtain specific calculated data from the Ozone website.
