Trial Chamber I

New trials will start as soon as Trial Chamber capacity is available.

Trial Chamber II was engaged in three trials concurrently during the second mandate.

The author was indicted by the First Chamber of the Provincial Court of Malaga (Sección Primera de la Audicencia Provincial de Malaga).

The Trial Chamber denied this motion on 10 November 2005.

On 15 July 2004, the Appeals Chamber rendered a decision on Mugiraneza's appeal against the decision of the Trial Chamber on exclusion of evidence by directing the Trial Chamber to reconsider Mugiraneza's request.3 The Appeals Chamber also dismissed the Prosecutor's counter appeal.

Trial Chamber III heard three trials contemporaneously during the second mandate.

The third of the joinder motions was refused by the Trial Chamber and the Prosecution has not appealed that decision.

On 19 September 2005, Trial Chamber I commenced the Mpambara trial.

Trial Chamber II was engaged in three trials concurrently during the second mandate.

Trial Chamber III heard three trials contemporaneously during the second mandate.

Following the commencement of the third mandate in 2003, Trial Chamber I was reconstituted and has been hearing the continuation of the Military I case (Bagosora, Kabiligi, Ntabakuze and Nsengiyumva), transferred from the previous Trial Chamber III.

The Chamber heard 10 prosecution witnesses over the course of eight days.

That provision grants a Trial Chamber broad discretion in assessing the admissibility of evidence.8

The presiding judge at the trial level withdrew from the case, and the remaining judges decided to continue the trial with a substitute judge.

Since the May 2005 report, two motions for joinder filed by the Prosecution have been approved by decision of the Trial Chamber.

The Appeals Chamber noted that the reasons for which the Trial Chamber had certified the appeal were unclear, as the matters contained therein appeared to relate to the admissibility of the diary as evidence, which should be dealt with by the Trial Chamber in accordance with rule 89 (C).

On 8 July, Pre Trial Chamber II issued the first arrest warrants of the Court in the situation in Uganda.

On 3 December 2003, Trial Chamber I delivered judgement in the so called Media case .

However, it follows from the ICTR Statute that a Trial Chamber Section must be comprised of both permanent and ad litem judges.

However, owing to the delay in establishing the second trial chamber, the third trial only commenced in March 2005.

It has also been hearing the continuation of the Military I case (Bagosora, Kabiligi, Ntabakuze and Nsengiyumva), transferred from the previous Trial Chamber III.

On 20 September 2004, a different Trial Chamber Section commenced the Military II trial, in which the Prosecution is presenting its case.

These cases will result in single accused trials, some of which will commence in 2006, depending on Trial Chamber capacity.

Following the reconstitution of the Chambers in early June 2003, this case was transferred to Trial Chamber I (see para. 9 above).

Through pre trial and pre defence status conferences, a Trial Chamber has the authority to streamline trial proceedings.

(c) Trial Chamber III Judge Andrésia Vaz (Senegal), Judge Khalida Rashid Khan (Pakistan) and Judge Dennis Charles Michael Byron (Saint Kitts and Nevis)

The Appeals Chamber dismissed Niyitegeka's appeal in its entirety and affirmed the sentence of imprisonment for the remainder of his life which had been imposed by the Trial Chamber.

Judges of the second Trial Chamber were appointed by the Secretary General and the Government of Sierra Leone in January 2005, and the third trial began in March 2005.

I also wish to inform the Council that since the submission of the report, another sentencing judgement was rendered by the Trial Chamber in the Bralo case, on 7 December.

A third trial, in the case of three members of AFRC, was delayed owing to the unavailability of a complement of second Trial Chamber judges.

It affirmed the sentences of 10 years' imprisonment and 25 years' imprisonment imposed by the Trial Chamber on Elizaphan Ntakirutimana and Gérard Ntakirutimana, respectively.

The completion of the Revolutionary United Front (RUF) trial at the trial chamber stage is estimated to take place by the end of 2006, and at the appeals stage by early to mid 2007.

The decision to transfer cases to national jurisdictions after the confirmation of indictments is a judicial one and will be taken by the Trial Chambers on a case by case basis.

Two trials began in June and July 2004, respectively, before the first Trial Chamber, which is alternating them on a six week basis.

In the Bisengimana case, the Trial Chamber accepted a guilty plea from the accused on 7 December 2005 for crimes against humanity, including extermination and murder.

These cases will result in single accused trials, some of which will commence in 2005, depending on Trial Chamber capacity.

In December 1985, the First Chamber of the Provincial Court of Malaga, allegedly composed of the same judges who had indicted him, sentenced him for fraud.

On 3 December 2003, Trial Chamber I finalized the judgement in the so called Media Case , which was heard during the second mandate.

The Trial Chamber also commenced trial in the Government case, involving four government ministers (Casimir Bizimungu, Justin Mugenzi, Jerome Bicamumpaka and Prosper Mugiraneza), and is approaching the end of the Prosecution case.
