The Government was still considering whether it would be better to follow up criminal sanctions against perpetrators with a rehabilitation programme.

Monitoring of sanctions implementation by sanctions committees and monitoring mechanisms, in accordance with relevant Council resolutions, can increase the effectiveness of sanctions.

Mr. Bessler noted that although the trend had shifted from comprehensive to targeted sanctions, methodologies for assessing the humanitarian implications of certain sanctions remained important.

As an example of the evolution of targeted sanctions, lists of individuals and entities drawn up by sanctions committees play an increasingly important role in achieving the objectives of targeted sanctions.

The systematic establishment of monitoring mechanisms to support, monitor and assess the implementation of sanctions and to provide technical advice to the sanctions committees is an important development.

These monitoring mechanisms assist the respective sanctions committees with monitoring and assessing the implementation of sanctions, as well as with providing technical advice.

Sanctions are one such option.

Ms. Lehto shared her experience on sanctions implementation in Finland and observed that in the light of the increased sophistication and complexity of sanctions regimes, the work of sanctions committees was not sufficiently transparent.

In this regard, we encourage States to share information, including by widely distributing the International Criminal Police Organization United Nations special notices concerning people subject to this sanctions regime

The Chairman emphasized that the issue of the implementation and enforcement of sanctions was essential to the success of any sanctions regime.

He also suggested that sanctions committees, rather than monitoring mechanisms, be entrusted with the task of designating individuals and entities subject to targeted sanctions.

We also thank the Committee's Analytical Support and Sanctions Monitoring Team for its work to improve the effectiveness of the sanctions regime.

In that connection, the view was expressed that the countries especially affected by sanctions regimes, including target countries, should be given access to sanctions committees to explain their situation directly related to the implementation of sanctions.

However, that agreement cannot be secured until it is incorporated into the Council's rules of procedure.

Such sanctions may include monetary sanctions.

Sanctions regimes should be subject to periodic review and adjustment, taking into account the humanitarian situation in the target State.

Professor Lopez referred to the effectiveness of sanctions and elaborated on the conditions under which sanctions were likely to succeed or fail.

A better understanding of sanctions lists, and of their potential and limitations, is required at the level of sanctions committees and States.

Prompt action by sanctions committees and increased transparency in their work can have a positive impact on the level of preparedness of States to implement sanctions.

Moreover, sanctions regimes should be subject to periodic review and adjustment, taking into account the humanitarian situation in the target State.

It is also a source of some of the problems associated with them.

Sanctions must also be kept on the table.

Moreover, sanctions did not necessarily bring about a change in the policies of the target country, and they affected third countries.

Such concerns may discourage States from submitting names or applying sanctions with the required rigour, thereby undermining the credibility and effectiveness of the sanctions regime.

108. We call upon the Security Council, with the support of the Secretary General, to improve its monitoring of the implementation and effects of sanctions, to ensure that sanctions are implemented in an accountable manner, to review regularly the results of such monitoring and to develop a mechanism to address special economic problems arising from the application of sanctions in accordance with the Charter.

At the same time, they underlined the need for improved mechanisms for implementation and monitoring.c Several delegations held the view that sanctions committees should engage in increased consultations with targeted States as well as with other States affected by the imposition of sanctions.

With respect to the Al Qaida and Taliban sanctions Committee, the sanctions regime has been greatly enhanced since the adoption of resolution 1267 (1999) in order to adapt it to the evolution of the menace.

The International Criminal Court is complementary to national criminal jurisdictions.

(k) Ensure that Security Council sanctions are effectively implemented and enforced, including by strengthening the capacity of Member States to implement sanctions, establishing well resourced monitoring mechanisms, and ensuring effective and accountable mechanisms to mitigate the humanitarian consequences of sanctions.

Such a process could also benefit the work of other sanctions committees.

C. Socio economic and humanitarian impact assessments

Italy

There was wide agreement that sanctions should be designed in such a manner so that their long term effects are considered and their effects on civilian populations are minimized or avoided on the basis of an assessment of humanitarian impact, that they should be subject to periodic review and that the measures imposed should be conducive to achieving the intended goals.

The letter also noted that various reports by expert sanctions monitoring bodies had included recommendations for improving the implementation and effectiveness of sanctions as well as for mitigating their unintended impact.
